No Haryana nod for sanction in 2 yrs, trial of right-wing activists yet to start

After recent acquittal in Rajasthan of the accused allegedly involved in lynching of Haryana dairy farmer Pehlu Khan, a similar case in Haryana involving rightwing activists who thrashed a Muslim trader in the premises of Hisar mosque for not chanting ‘Bharat Mata Ki Jai’ seems to be going the same way.


The case grabbed national headlines after video of jingoistic assault by right-wing activists on the Muslim man went viral in July 2017. However, the trial is yet to start even after two years because the Khattar government in Haryana is yet to grant sanction for prosecution. Normally, sanction in such cases is granted by the state government within three months.

The incident had taken place on July 11, 2017 and a letter seeking sanction to prosecute the accused was sent to the state’s home department, which is headed by chief minister Manohar Lal Khattar himself, on August 19, 2017. However, till date no sanction has been received.

From October 17, 2017 till date, the matter has come up for hearing before the trial court in Hisar around 13 times and every time the trial court directs the Hisar district administration to send reminder to the state government for sanction of prosecution so that the trial can commence.

The charges against the accused in this case include Section 295-A (hurting religious feelings) because of which permission under Section 196 of the Criminal Procedure Code (CrPC) is required from the state's home department to start prosecution.


‘Bad elements who tried to disturb social fabric being protected’

Talking to TOI, the victim, Mohammad Haroon Kasni, said the issue was not related to him alone but concerns freedom of all religions, as such an incident can happen with anybody. “The truth of that incident is before everyone that I was attacked without any provocation while sitting in a mosque. It can happen with anyone in temple or gurdwara because of some anti-social elements. It is shocking that the state that has to protect its citizens is not giving permission to prosecute those who had acted against the law of the land,” said the 32-yearold from Saharanpur in Uttar Pradesh.

Hoshiar Khan, president of Muslim Kalyan Committee Hisar and general secretary of Muslim Khidmat Sabha, who has been taking up the matter in Hisar court and with the local authorities, said it was really a sorry state of affairs that some unscrupulous elements who tried to disturb social fabric and communal harmony are being protected by the government.

Khan accused some senior cops in the Hisar district of openly favouring the accused and forcing him to close the matter through compromise.

“We have no problem to enter a compromise for communal peace and harmony, but only if the accused accept their mistake socially. Unfortunately, except one woman SP, all other cops of Hisar district only sided with the accused for the reasons best known to them,” Khan added.

Khan, who retired as a supervisor from Haryana irrigation department, said it was unfortunate that some anti-social elements with criminal background were being shielded, who would only create trouble in society if not punished or if they don’t realize their mistake.

When contacted, Hisar SP Shiv Charan completely expressed ignorance about the case. In a complete evasive response, the SP said that no such case was in his memory.

As the Haryana CM, who holds the home portfolio, was busy with his party’s yatra, his media adviser Rajiv Jain said he was aware of the incident and assured he would get back after getting details from the concerned officers. He, however, did not respond when contacted again
