SC status quo in mgmt admissions


The Supreme Court on Wednesday ordered status quo in fresh admissions to management courses in the state. The interim order is significant as it means that it preserves the status quo of admissions granted last month in Jamnalal Bajaj Institute of Management Studies (JBIMS) as well as any cancellation of admissions earlier this month as those seats cannot be filled in till the matter is heard finally by the SC.

The SC bench of Justice Indu Malhotra and Justice Indira Banerjee on Wednesday issued notice to all parties, including the University Grants Commission (UGC) and set the matter for final hearing on August 28.

Almost 40 students who had apprehended cancellation of their admissions pursuant to a July 25 ruling of the Bombay high court had gone to the SC against the HC order. The HC had directed the state government had to rework its admission process after it had held that JBIMS was an autonomous institute as sought by a set of nine students who had petitioned the HC.

The SC heard arguments by counsels including Shekhar Naphade and C U Singh for the students who had approached the SC and Satish Talekar for students who had originally filed the petition in the HC. The HC had said: “The issue raised before us is decided only in the backdrop of the status of this JBIMS. The petitioners claim that it is an autonomous institute, whereas, the state, through its cell, has categorised it as non-autonomous. That categorisation has not been sustained and upheld by us
