The Punjab and Haryana high court has held that a person, who is partially colour blind, cannot be recruited as a constable in the police department. “Since the constable is to be posted on different duties, including traffic duty, even minor colour blindness can prove fatal in many cases,” the high court said.


In this case, the candidate was initially declared medically unfit for selection as a constable due to his colour blindness. Later, a medical board of Post Graduate Institute of Medical Education and Research (PGIMER), Chandigarh, found him partially colour blind and declared him fit for the police job.

However, a division bench comprising Justice Rajiv Sharma and Justice Kuldip Singh allowed an appeal filed by the home department of Chandigarh administration against the decision of Chandigarh bench of the central administrative tribunal (CAT).

In this case, Rinku Yadav, a resident of Mahendergarh in Haryana, had applied for the post of constable (executive) under OBC category in Chandigarh Police, which had advertised 1,200 posts. He cleared the physical endurance test and written test held on November 14, 2010 as well as interview.

During the medical examination, the principal medical officer, Chandigarh administration, Government Multi-Specialty Hospital, Sector 16, Chandigarh, declared him medically unfit on account of “colour blindness”.

A review medical board of three eye specialist doctors from Government Medical College and Hospital (GMCH), Sector 32, Chandigarh, and GMSH-16 also declared him unfit due to “colour vision defect”. The board was of the view that the job aspirant could not identify most of the initial 21 slides as well as tracing slides on Ishiara colour vision book. In the lantern test too, he could not identify colour through medium aperture.

Thereafter, the candidate approached the CAT Chandigarh, which on January 9, 2012 ordered a special medical board of PGI, Chandigarh.

The PGI opined the candidate had partial red and green colour deficiency on Ishiara colour plate. However, on the Eldridge Green’s Lantern test, he was able to identify red and green colour with all aperture at the distance of 5 metres. “He possesses higher grade of colour perception on Lantern’s test and is able to identify red and green colour through an aperture of 1.3 mm at a distance of 5 metres with 5 seconds time of exposure,” the board said.

Based on the PGI report, the CAT on July 17, 2012 ordered the home department of the Chandigarh administration to consider him medically fit for appointment. Aggrieved from CAT orders, the UT Chandigarh home department had filed an appeal.

Hearing all the parties and examining the medical record, the HC has held that even the report of PGI shows that the applicant has partial colour blindness, as found in Ishiara colour plate. “Even through the Eldridge Green’s Lantern Test, he was able to identify red and green colour only through aperture of 1.3 mm at the distance of 5 metres. Earlier, before the board of three doctors, he had failed the lantern test also through medium aperture. Even though the applicant is held to be partially colour blind, he cannot be treated as medically fit for appointment,” observed the high court bench
