RERA can’t reduce completion period of project, rules HC

Chandigarh : The Punjab and Haryana high court has held that the Real Estate Regulatory Authority (RERA) has no power or jurisdiction to reduce the time period for completion of a housing project declared by a developer. If it feels that the period mentioned is arbitrary or unacceptable due to any reasons, a notice to show cause for rejection of the application must be given, it added.

The high court was hearing a plea from M/s Parador Developers (Amritsar) Private Limited, an Amritsar-based developer who had challenged the authority decision about the same and subsequently upheld by the RERA tribunal. The developer had sought permission for change of land use in October 2017 of an area measuring 93.265 acres for development of a residential colony. The department of town and country planning, Punjab, granted permission the same month and subsequently he secured license in July 2019 for a completion period upto June 2024.

The developer filed an application in September 2019 before the RERA authority for registration of the project under Real Estate (Regulation and Development) Act, 2016 with a completion deadline of June 2024. The authority, however, reduced the completion period by one year. The developer filed an appeal against the same before the RERA tribunal but the same was dismissed in July 2020 following which the developer had moved high court, his counsel, Shekhar Verma said.

The court of justice Sudhir Mittal observed that a perusal of sub-section 3 of Section 5 of the RERA Act leaves no manner of doubt that registration granted under Section 5 of the law would be valid for a period declared by the promoter.

The bench further observed that under section 5 of the Act, the authority has the power either to register a project or to refuse registration but before refusal, an opportunity of hearing must be granted to the developer. “There could be many reasons for refusing to register a project and one of them could be an arbitrary time period mentioned in the declaration. Thus, if a promoter mentions an inordinately long period in its declaration or for some other reason the authority finds the same to be illogical and arbitrary, it could reject the application, however, not without grant of opportunity of hearing,” the bench said.

The court asked RERA authority to pass a fresh order within seven days.
