HC notice to Cong MLA on rival’s election petition

The Punjab and Haryana high court has issued a notice to Kalka MLA Pradeep Chaudhary of the Congress on a plea challenging his election by Bhag Singh Damdama of Jannayak Janta Party (JJP). Bhag has challenged Chaudhary’s election on the ground that his nomination was wrongly and illegally cancelled by the returning officer (RO).

“The illegal act of the RO in rejecting the nomination paper has prevented the petitioner from contesting the election as member of legislative assembly from Kalka constituency. This was done just to ensure the election of the respondent (Pradeep Chaudhary).

“Thus the election of Pradeep Chaudhary as member of legislative assembly constituency Kalka is totally illegal and void,” advocate Surjit Singh Salar, counsel for Bhag, has submitted in the HC.

Hearing the plea, the HC has issued notice to Chaudhary seeking his response on the issue.

In his petition, Bhag has submitted that he had filed his nomination as JJP candidate from Kalka assembly seat during the 2019 assembly polls. However, his nomination as cancelled because of deletion of his name from the voter list.

HC was informed that now it has been proved that his name was wrongly deleted and an inquiry has also been ordered.

The matter would now come up for hearing on February 4.

Recently, the Haryana government had terminated two government employees and the state election commission recommended action against three other senior officials including former SDM, Kalka, former BDPO Raipur Rani and a booth level officer in relation to the missing of record pertaining to voter list of Kalka.

The action was taken by the government in the wake of an ealier petition filed by Bhag Singh. He had approached the HC because his nomination was cancelled after his name was found missing in the voters list.

During the hearing of the case, the record pertaining to the voters list was found missing after which the HC had asked the state about the action taken.
