Four rebel MLAs say they have not severed link with INLD
CHANDIGARH : Arguing why the Indian National Lok Dal (INLD) didn’t take action against her for the “alleged anti-party activity,” Naina Singh Chautala, the defiant daughter-in-law of INLD supremo Om Prakash Chautala has told Haryana Vidhan Sabha Speaker that her “act and conduct” as INLD MLA never violated the spirit of anti-defection law.

The Dabwali MLA Naina Chautala, wife of former MP Ajay Chautala, who is elder son of former Haryana chief minister Om Prakash Chautala, is facing a case to disqualify her as legislator for indulging in anti-party activities. Three other INLD MLAs Prithi Singh (Narwana), Rajdeep Singh (Dadri) and Anoop Dhanak (Uklana) are also facing similar case that is pending before Speaker Kanwar Pal.

At the core of allegations against the four MLAs is that after the split in Chautala family last year, Naina’s elder son and former MP Dushyant Chautala formed the Jannayak Janta Party (JJP) and that Naina along with other three MLAs not only attended political functions of the JJP but also extensively campaigned for the JJP during the Lok Sabha elections.


The INLD had petitioned the Speaker to disqualify the four MLAs for violating the anti-defection law. The case was filed by MLA Balwan Singh Daulatpuria, who on June 7 joined the BJP and resigned as INLD MLA.

“Thus, the petitioner (ex-MLA Daulatpuria) has lost his claimed locus standi and this petition

deserves to be dismissed. There is no documentary evidence on the record to corroborate that any of the acts, conduct and speech of the respondents may attract disqualification,” Naina Chautala has said in her July 11 and 64-page reply to Speaker’s notice.

“The present petition is legally/Constitutionally defective. Contents of the instant petition are denied being vague…false…and suffering

from vice of non-application of mind.”


Three other MLAs in question have too filed almost identical replies.

Not this, the four rebel MLAs stated that neither they have left the INLD voluntarily nor “joined any other political party.” In their separate responses, the four MLAs have stated that none of their conduct and actions attracts disqualification.


Naina Chautala has submitted that neither has she “dissented in the House” nor “severed link with the INLD legislative party. “There is no violation of the spirits of the Anti-defection law in any manner,” she said in her reply.

Responding to INLD’s accusations about attending political rallies and programmes of the JJP, the first-time MLA Naina Chautala said: “In democratic forum of polity, sometime, one has to share the platform of meeting of various bodies along with the politicians, office-bearers of various parties during official, social, private functions.”

She further stated that “even if it is presumed” that she attended political functions of other political outfit “she has not acted” in such a manner that may attract disqualification under the Antidefection law.

In his petition, ex-INLD MLA had urged the speaker to “disqualify” the MLAs on account of voluntarily giving up the membership of original party INLD. The party also demanded to recover all salary and emoluments which the rebel MLAs received till date.

“There is no evidence available on record from which the petitioner has verified all these facts that the respondents have voluntarily given up the membership of the INLD. The petitioner has failed to specify under which provision of the Tenth Schedule the respondents have incurred disqualification,” Naina Chautala has said, pointing out four specific flaws in the petition that she said is “false”
