The Punjab and Haryana high court on Monday directed Gurgaon police not to take any coercive action against two prominent nightclubs operating on the city’s upscale MG Road. Following this, other clubs on the stretch also decided to approach the court against withdrawal of no objection certificates (NOCs).


The administration had issued them notices on July 24, revoking their NOCs for not following some regulations, which included directions restraining the entry of single women and making submission of marriageproof mandatory for couples entering the pubs.

“In the meantime, the operation of the July 24 order shall remain stayed. No coercive steps be taken except general duty surveillance and without harassing the mall goers,” ordered the HC.

Justice Rajiv Narain Raina passed these orders while hearing a petition filed by ‘Empire’, and ‘Queens Club’, at MGF Metropolitan Mall. The HC has also asked the commissioner of police and the Gurgaon deputy commissioner (DC) to file their replies on the petitioners’ contentions by August 23.

The petitioners alleged that FIRs were registered against some of the clubs and bars. “However, at the behest of the business rivals, who have close ties with the political leaders of the incumbent party, action had been initiated unnecessarily,” they said.

Counsel for the petitioners Chetan Mittal argued that all the permissions from the authorities to run the clubs had been obtained. All the instructions and guidelines, which had been issued by the government, including biometric entry for men visiting after 10 pm in the mall itself where the bar and restaurant of the petitioners are situated were followed strictly. Senior advocate Chetan also told the HC that there were certain verbal guidelines from the police to the bar and restaurants for not allowing entry of single women in pubs, including that they should be accompanied by their husband with marriage certificate .

“However, that was widely criticised being a restriction on the women. Even after that under the garb of checking the police officers have started unnecessarily harassing the owners of the bar and restaurant and to that effect as a protest all the bar owners had closed the bars on July 6 and protested the harassment at the hand of police,” Mittal told the HC.

After the protests, the notice on cancellation of NOC was issued. Counsel for one of the petitioners Mohinder Singh Nain contended that the order of the police commissioner was in excess of jurisdiction and a kneejerk reaction.

“The order has been passed without notice or offering hearing to the petitioners. Besides, it has caused serious loss of business to the petitioners which the police department may ultimately be responsible for passing the order,” Nain said.

Owner of a club on MG Road, on condition of anonymity, said the FIRs had been registered against only three clubs on Mall Mile, and there was no reason to act against 10 clubs on the road. “Police and the administration should act against those who were found guilty and booked, why they are punishing everyone,” he said, adding that why only clubs on MG Road is being punished while others on Golf Course Road, Sector 29 and Cyber Hub had been left off the hook.
